List Your Store on BuyNearby

BuyNearby — Vendor Platform Agreement

This Vendor Agreement ("Agreement") is entered into between BuyNearby Inc. ("Platform") and you ("Vendor") upon submission of this application and activation of your store listing.

1. Platform Access. BuyNearby grants you a non-exclusive right to list products and receive orders through the platform. The platform reserves the right to approve, suspend, or remove listings that do not comply with platform policies.

2. Local-Only Policy. BuyNearby is a local commerce platform. Only independently-owned businesses operating from a physical Calgary-area location may list on the platform. National chains, franchises, and fulfilment centres are not eligible.

3. Fees & Payouts. BuyNearby retains a platform fee on each order (currently 15% of the product subtotal). The remaining amount is paid to the Vendor automatically upon delivery confirmation, via the payout method selected during onboarding. Delivery fees are separate and go to the driver — not deducted from your payout. Fees may be updated with 14 days written notice.

4. You Shop, We Deliver Program. If you participate in the You Shop, We Deliver program, you agree to notify BuyNearby of any phone or walk-in orders you wish to have delivered, and to have the order ready for driver pickup within the agreed window. BuyNearby is responsible for delivery once the driver picks up. You are responsible for accurate packing and order contents.

5. Third-Party Platform Delivery. If BuyNearby is providing delivery services for orders originating on another platform (e.g. your Shopify or WooCommerce store), you are responsible for notifying us of each order and having it ready for pickup. Delivery pricing applies as per the courier rate card posted on your vendor dashboard.

6. Product Accuracy. You are responsible for ensuring products listed are available, accurately described, and priced correctly. BuyNearby is not liable for customer disputes arising from inaccurate product information.

7. Age-Restricted Items. If you sell age-restricted products (alcohol, tobacco, cannabis accessories), you acknowledge that the driver will verify customer ID before delivery. You must comply with all applicable Alberta laws regarding sale of restricted goods.

8. Privacy. Customer contact and order information is provided to you solely for the purpose of fulfilling that order. You may not use customer data for marketing or any other purpose without explicit consent.

9. Governing Law. This agreement is governed by the laws of Alberta, Canada.
